Eles não têm brinquedos, berços, alimentação e assistência médica adequadas. São brasileirinhos, de até 2 anos, mantidos em penitenciárias ao lado das mães, quase todas presas por tráfico de drogas. Embora a legislação lhes garanta o mínimo de conforto, convivem com o que há de pior no precário sistema prisional, como se estivessem também cumprindo pena. Passam dias e noites em espaços apertados e isolados do mundo. Nem sequer conhecem uma galinha ou um cachorro e não têm contato com outras crianças, o que prejudica o seu desenvolvimento. Pare e pense agora nas mazelas do poder judiciário, que abriga em seus palácios juízes que não tem a menor responsabilidade com o social de seus presos tampouco abrem mão de seus megas aumentos.
Continuando. Engatinham, mamam no peito, comem papinha, não desgrudam das chupetas, fazem gracinhas e causam emoção ao falar "mamãe". O que os torna diferentes é o ambiente à volta. Em vez de quartos limpos, cheirosos, coloridos de rosa ou azul e decorados com motivos infantis, centenas de brasileirinhos, de até 2 anos, vivem trancafiados em celas fétidas de presídios femininos nos quatro cantos do país, alguns em condições subumanas. No lugar dos gradis dos berços, as crianças que nasceram no cárcere e nunca passaram dos portões das penitenciárias conhecem apenas as grades que os confinam com as mães, condenadas ou esperando julgamento por seus crimes. Aos filhos do cárcere, liberdade é algo distante. Resta-lhes um único direito: o amor materno.
Essa é realidade chocante e desconhecida da nossa presidente Dilma Rousseff e do ex-Lula que sancionou a Lei 11.942/2009 que diz: “Os estabelecimentos penais destinados a mulheres serão dotados de berçário, onde as condenadas possam cuidar de seus filhos, inclusive amamentá-los, no mínimo, até 6 meses de idade”.
Se por um lado o Brasil tem uma legislação avançada para assegurar diretos a presidiárias e seus filhos, por outro, na prática, é diferente. Aliás, tudo no Brasil, na prática não funciona. Bem ao jeito brasileiro, o que há atrás das grades é um arremedo de assistência. Uma colcha de retalhos costurada pela direção dos presídios, que tem o poder de determinar o tempo de permanência do filho com a mãe, de acordo com as condições do deteriorado sistema carcerário brasileiro. Em Brasília, a criança é retirada da prisão aos 6 meses; em Curitiba, é possível que ela fique até os 6 anos. Em Minas, elas deixam o cárcere aos 2 anos e, no Pará, ao nascer. No Rio e em SP, idem.
O importante é que somos o país dos Jogos Olímpicos, da Copa, do Papa, dos Rafale, da corrupção e de Sarney... Vamos mostrar ao mundo aquilo que não somos!
